The VCA, effective June 27, 2006, provided for DTSC oversight <br /> activities as outlined in the Scope of Work contained in the VCA. DTSC's decision to <br /> terminate the VCA is based upon Kimball Hill Home's correspondence dated <br /> November 5, 2007, which provided official notice of termination of their purchase <br /> agreement for the Cabral-McAdams Site Property. Kimball Hill Homes had assumed <br /> the role of a prospective purchaser of the Cabral — McAdams Site Property and <br /> provided funding for the VCA. <br /> On September 1, 2006, in accordance with the VCA's Scope of Work, DTSC approved <br /> the Draft Preliminary Endangerment Assessment (PEA) Work Plan for sampling and <br /> analysis to assess the extent of residual pesticides present in the property's surface <br /> soil. The Draft PEA investigation report, dated October 16, 2006, confirmed that <br /> specified areas of the Site contained elevated concentrations of lead, arsenic and the <br /> organochlorine pesticides DDT and dieldrin in the surface soils. The contaminants are <br /> consistent with the Site property's historic use as an orchard for over 100 years. <br /> Based on periodic telephone discussions with Mr. McAdams and preliminary <br /> discussions held with Raney Geotechnical Inc. regarding preparation of the PEA's <br /> required Human Health Screening Evaluation, no additional activities have been <br /> conducted on the project since the spring of 2007. <br /> ® Printed on Recycled Paper <br />
