OBSERVATION: Copies of consolidated manifest receipts for the following hazardous wastes were not found on site during the inspection: - 50 gallons of hazardous waste with waste code 133 from 1/23/2017 - 92 gallons of hazardous waste with waste code 133 from 4/2/2019. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from 1/23/2017 and 4/2/2019 and maintain them on site. Provide a copy of the consolidated manifest receipts and a corrective action statement to the San Joaquin County Environmental Health Department. This is a Class II violation. 120 CCR 66266.81(a)(4)(B) Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. OBSERVATION: Bills of lading for the recycling of lead acid batteries from 12/20/2017 through 10/30/2019 were not found on site. REGULATION GUIDANCE: (A) The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR section 1161, to record the shipment of spent lead -acid storage batteries to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. (B) The generator shall retain, at the generator's place of business for at least three years, a legible copy of each manifest or bill of lading which identifies spent lead -acid storage batteries shipped to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. CORRECTIVE ACTION: Provide copies of battery core bill of lading records from 12/20/2017 through 10/20/2019 and a corrective action statement to the San Joaquin County Environmental Health Department within 30 days.
