I AND BOAT STORAGE activities in the County of San Joaquin and elsewhere in the State of <br /> 2 California. <br /> 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they <br /> ID <br /> 4 are doing business in the State of California, in the course of Defendant's MARINA AND BOAT <br /> 5 STORAGE activities, are pursuant to Health and Safety Code section 25181 hereby permanently <br /> 6 enjoined from: <br /> 7 a. Failing to maintain and operate facility to minimize the possibility of a fire, <br /> 8 explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of <br /> 9 California Code of Regulations, title 22 section 66265.31; <br /> 10 b. Failing to maintain all communication or alarm systems, spill control, or <br /> 11 decontamination equipment, in violation of California Code of Regulations,title 22 section <br /> 12 66265.33; <br /> 13 c. Storing hazardous waste on site greater than 180 days, in violation of California <br /> 14 Code of Regulations,title 22 section 66262.34(d); and <br /> 15 d. Failing to retain for at least three years, a copy of manifest or bill of lading which <br /> 16 identities shipping of spent lead-acid storage batteries, in violation of California Code of <br /> 17 Regulations, title 22 section 66266.8 1(a)(4)(B). <br /> 18 4. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they <br /> 19 are doing business in the State of California, in the course of Defendant's MARINA AND BOAT <br /> 20 STORAGE activities, are pursuant to Health and Safety Code section 25299.01 are permanently <br /> 21 enjoined from: <br /> 22 a. Failing to maintain written monitoring and maintenance records on-site, in <br /> 23 violation of California Code of Regulations, title 23 section 2712(b); <br /> 24 b. Failing to maiitain secondary contairunent system which prevented any releases <br /> 25 from flowing to a collection sump located at the low point of underground piping, in violation of <br /> 26 California Code of Regulations, title 23 section 2636(c)(1); <br /> 27 c. Failing to maintain a copy of the monthly inspection record and all attachments for <br /> 28 the previous twelve (12) months, in violation of California Code of Regulations,title 23 section <br /> -2- <br /> PERMANENT INJUNCTION <br />
