I AND BOAT STORAGE activities in the County of San Joaquin and elsewhere in the State of 2 California. 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they ID 4 are doing business in the State of California, in the course of Defendant's MARINA AND BOAT 5 STORAGE activities, are pursuant to Health and Safety Code section 25181 hereby permanently 6 enjoined from: 7 a. Failing to maintain and operate facility to minimize the possibility of a fire, 8 explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of 9 California Code of Regulations, title 22 section 66265.31; 10 b. Failing to maintain all communication or alarm systems, spill control, or 11 decontamination equipment, in violation of California Code of Regulations,title 22 section 12 66265.33; 13 c. Storing hazardous waste on site greater than 180 days, in violation of California 14 Code of Regulations,title 22 section 66262.34(d); and 15 d. Failing to retain for at least three years, a copy of manifest or bill of lading which 16 identities shipping of spent lead-acid storage batteries, in violation of California Code of 17 Regulations, title 22 section 66266.8 1(a)(4)(B). 18 4. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they 19 are doing business in the State of California, in the course of Defendant's MARINA AND BOAT 20 STORAGE activities, are pursuant to Health and Safety Code section 25299.01 are permanently 21 enjoined from: 22 a. Failing to maintain written monitoring and maintenance records on-site, in 23 violation of California Code of Regulations, title 23 section 2712(b); 24 b. Failing to maiitain secondary contairunent system which prevented any releases 25 from flowing to a collection sump located at the low point of underground piping, in violation of 26 California Code of Regulations, title 23 section 2636(c)(1); 27 c. Failing to maintain a copy of the monthly inspection record and all attachments for 28 the previous twelve (12) months, in violation of California Code of Regulations,title 23 section -2- PERMANENT INJUNCTION
