I 2715(e); <br /> 2 d. Failing to perform periodic testing of secondary containment system, in violation <br /> 3 of California Code of Regulations,title 23 section 2637(a); and <br /> 4 e. Failing to provide training by a designated underground storage tank operator for <br /> 5 facility employees on the proper operation and maintenance of the underground storage tank system <br /> 6 once every twelve (12)months , in violation of California Code of Regulations,title 23 section <br /> 7 2715(f). <br /> 8 5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 9 are doing business in the State of California, in the course of Defendant's MARINA AND BOAT <br /> 10 STORAGE activities, are,pursuant to California Business and Professions Code section 17204, <br /> 11 hereby permanently enjoined from: <br /> 12 a. Violating Health and Safety Code section 25100 et seq., as described in paragraph <br /> 13 3 —3(d) above; and <br /> 14 b. Violating Health and Safety Code section 25280 et seq., as described in paragraph <br /> 15 4 -4(e) above. <br /> 16 6. Defendants shall pay to Plaintiff the sum of SEVEN THOUSAND SEVEN HUNDRED <br /> 17 SIXTY-THREE DOLLARS AND SEVENTY-FIVE CENTS ($7,763.75), as and for civil penalties, <br /> 18 pursuant to Health and Safety Code §25299. Said payment shall be made payable to the SAN <br /> 19 JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT- ENVIRONMENTAL <br /> 20 HEALTH DIVISION TRUST. Said payments shall be delivered to the San Joaquin County Office <br /> 21 of the District Attorney, Environmental Prosecutions Unit, on or before September 15, 2014. <br /> 22 7. Defendants shall pay to Plaintiff the sure of SEVEN THOUSAND SEVEN HUNDRED <br /> 23 SIXTY-THREE DOLLARS AND SEVENTY-FIVE CENTS ($7,763.75), as and for civil penalties, <br /> 24 pursuant to Business and Professions Code section 17206. Said payments shall be made payable to <br /> 25 the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San Joaquin County Office of <br /> 26 the District Attorney, Enviromnental Prosecutions Unit, on or before September 15, 2015. <br /> 27 8. Defendant shall be penalized, as and for civil penalties,pursuant to Business and <br /> 28 Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 6 <br /> -3- <br /> PER AMENT INJUNCTION <br />
