SAN_ J O A Q U I N Environmental Health Department <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> D&S AUTOMOTIVE REPAIR 1 15257 S INHERITANCE WAY, Manteca September 18, 2019 <br /> Waste streams found: used oil, waste antifreeze, drained used oil filters, paper filters, lead acrid batteries, shop <br /> rags (laundered by Ameripride). <br /> The following first time minor violations were corrected on site: <br /> #105- No emergency coordinator <br /> OBSERVATION The modified contingency plan listed an emergency coordinator who no longer works at the <br /> business. <br /> REGULATION GUIDANCE The emergency coordinator or his designee must respond to any emergencies that <br /> arise. The business operator must post the following information next to telephones or in areas directly involved <br /> in the generation and accumulation of hazardous waste: the name and emergency telephone number of the <br /> emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of <br /> the fire department unless the facility has a direct alarm. <br /> CORRECTIVE ACTION: The old emergency coordinator was removed from the modified contingency plan. <br /> Corrected on site. <br /> #603- Failed to mark initial accumulation start date on satellite containers <br /> OBSERVATION The 55 gallon drum of paper filters did not have an accumulation start date and disposal <br /> records were not available for review at time of inspection. <br /> REGULATION GUIDANCE The initial date of waste accumulation must be clearly marked and visible for <br /> inspection on each container used for satellite accumulation of hazardous waste. <br /> CORRECTIVE ACTION: Tom Parlet, owner, called Asbury Environmental and was told the last pick up of paper <br /> filters occurred on December 2018. The container of paper filters was labeled with 12/1/18. Lid was obtained for <br /> drained used oil filters. Corrected on site. <br /> #608- Failed to properly manage used oil and fuel filters <br /> OBSERVATION Containers of used metal oil filters out of compliance with the storage rules were observed <br /> on-site. The 55 gallon used metal oil filter container was not marked with accumulation start date and did not <br /> have a lid. <br /> REGULATION GUIDANCE <br /> (b) "used oil filters" are defined as filters which contain a residue of used oil and which are exempt from <br /> regulation as a hazardous waste under the scrap metal provision found in federal law. <br /> (c) Used oil filters that meet the conditions of subsection(b) of this section and are managed and recycled in <br /> compliance with the following requirements shall not be regulated as hazardous waste. <br /> (1) The filters are drained of free-flowing used oil. For the purposes of this subsection, free-flowing is defined as <br /> a continuous stream of oil exiting the filter when the filter is inverted. Oil exiting drop by drop is not considered to <br /> be free-flowing. However, if the filter is equipped with a device(such as a rubber flap located just inside the filter <br /> opening) which impedes the drainage of used oil from the filter, that device shall be manipulated to allow the oil <br /> to exit the filter freely, or the filter punctured, crushed, opened, drained, or otherwise handled in a manner that <br /> will allow the used oil to exit the filter. <br /> (2) The drained used oil filters are transported for purposes of metal reclamation to any of the following: <br /> (A) A smelter or other scrap metal processor where they are recycled or; <br /> (B) A storage facility or consolidation facility that subsequently transfers the filters to a facility described in <br /> paragraph (A) or (C) of this subsection or; <br /> FA0015163 PR0523226 SCO01 09/18/2019 <br /> EHD 22-01 Rev.8/22/2019 Page 6 of 7 Small Quantity Hazardous Waste Generator OIR <br /> 1868 E.
