STATE OF CALIFORNIA ® 0 Page 3 <br />DEPARTMENT OF GENERAL SERVICES <br />PROCUREMENT DIVISION <br />Contract (Non -Mandatory) 1-07-65-54-A <br />Additional Services <br />Refer to Exhibit A for Contractor's fees and services. <br />The contractor shall permit eligible local governmental agencies to participate under this <br />contract. Local government agencies are defined as "any city, county, city and county, <br />district or other governmental body or corporation, including the California State Universities <br />(CSU) and University of California (UC) Systems, K-12 schools and community colleges", <br />empowered to expend public funds for the acquisition of products, in accordance with <br />Public Contract code Chapter 2, Paragraph 10298 (a) (b). Authorization to permit a local <br />governmental agency to participate in this contract shall come through the State's Contract <br />Manager. Participating agencies shall provide and maintain DEA (Drug Enforcement <br />Agency) registration and license (as clinic or pharmacy) by either the State Board of <br />Pharmacy or license as a health care provider by the Department of Public Health. <br />Agencies that are eligible to participate but are not currently using the State's <br />pharmaceutical wholesale distributor, AmerisourceBergen Drug Corporation, must contact <br />Loretta Maddux, the DGS contract manager, at 916-375-4926 or <br />Loretta. MadduxQdgs.ca.gov to determine eligibility and enrollment. <br />Local governmental agencies shall have the same rights and privileges as the State under <br />the terms of this contract. Any agencies desiring to participate shall be required to adhere <br />to the same responsibilities as do State agencies and have no authority to amend, modify <br />or change any condition of this contract. <br />RJEWalam dim Lai I <br />Available products, product pricing, price per dose and per unit of sale and other pertinent <br />information for Guaranteed Returns are provided in Exhibit A. AmerisourceBergen Drug <br />Corporation's pricing for credit processing will be added as an amendment to this <br />notification. <br />All prices quoted shall be the maximum for the term of the contract; no price increases shall <br />be permitted. <br />SALES/USAGE TAX <br />Participating agencies are advised that sales/usage tax is not applicable to this contract for <br />services. <br />3. CONTRACT USAGE/RULES <br />A. The use of this contract is non -mandatory for State agencies, Other branches of <br />government, constitutional officers, and other State agencies such as California State <br />Universities and local governments can also take advantage of this contract. <br />B. Local governmental agency use of this contract is optional. While the State makes this <br />contract available to eligible local governmental agencies, each local governmental <br />agency should determine whether this contract is consistent with its procurement <br />policies and regulations.
