AGENCIES' RESPONSIBILITIES <br />A) Agencies are responsible for accurate and timely completion of Exhibit B, MMCAP's <br />facility membership form. Agencies must return the completed Exhibit B to DGS in order <br />to be enrolled to use this contract. <br />B) If an Agency is not currently enrolled with the State's pharmaceutical wholesale <br />distributor, AmerisourceBergen Drug Corporation, the agency must contact the DGS <br />contract manager to determine eligibility and enroll. <br />C) Agencies shall provide and maintain DEA registration and license (as clinic or <br />pharmacy) by either the State Board of Pharmacy or license as a health care provider by <br />the Department of Public Health. Agencies must provide a copy of current DEA <br />registration and state license to the DGS upon registration or license renewal or other <br />action. <br />D) Agencies must use only those MMCAP contracts which the DGS has authorized <br />Currently the only MMCAP contract authorized by the DGS is the contract with <br />Guaranteed Returns for pharmaceutical reverse distribution and destruction. <br />E) Agencies must not process corrosive and flammable materials in quantities larger than <br />the amount exempted by UPS through this contract. <br />F) Agencies shall ensure available funding for the contract releases/delegation purchase <br />orders they issue. <br />G) Eligible Local Agencies shall contact the DGS and provide applicable licensure to the <br />DGS for utilization review and approval. <br />H) Agencies must complete paperwork and follow procedures as instructed by the returns <br />company. Agencies must complete inventory forms provided by the returns company <br />before shipping. <br />1) Agencies must comply with federal, state, and local regulations. <br />J) Agencies must comply with HIPAA (Health Insurance Portability and Accountability Act). <br />Agencies must remove any Patient Health Information (PHI) from product destined for <br />reverse distribution or destruction. <br />K) Agencies must provide a DGS assigned agency billing code to the DGS at the time of <br />enrollment. <br />
