may, from time to time, be established for similar services by other public <br /> agencies. Notice of any change desired under this section shall be made by the <br /> Contractor to the City prior to April lst of any year for action by the City for <br /> the ensuing fiscal year. <br /> (b) It is hereby expressly agreed that the Contractor may dispose <br /> of the garbage and refuse of persons other than the City and the City shall from <br /> time to time establish a rate for these services. Commencing on the 20th day of <br /> the second month following the beginning of the operation and maintenance of said <br /> disposal facility Contractor shall pay to the City all monies received from these <br /> third persons according to the following schedule: <br /> (1) For household garbage City shall receive all revenues <br /> collected in excess of twenty-five cents ($+00.25) per <br /> uncompacted cubic yard. <br /> (2) For refuse City shall receive all revenues collected in <br /> excess of forty cents ($00.40) per cubic yard. <br /> (c) It is further agreed that the City or its contractual agents <br /> shall not deliver to, and the Contractor shall not receive, at the Site, any <br /> garbage Prating from an area outside the corporate limits of the City of Stockton, <br /> without the written mutual consent of both the Contractor and the City. <br /> 12. Contractor may use whatever amount of residuary ash he deems necessary <br /> to improve and maintain the Site. The City may use for its own needs whatever part <br /> of the remaining ash it may deem necessary for its purposes. Whatever ash the Con- <br /> tractor does not use on the Site and the City does not use for its own needs, the <br /> Contractor may use for its own needs elsewhere than on the Site. If any ash re- <br /> mains after the appropriations set forth above, the City may sell such ash to <br /> third parties of its choice and the net profit directly attributable from such sales <br /> shall be evenly divided between Contractor and City. Net profit shall be understood <br /> to be the difference between the gross sales price and the cost of loading, dumping <br /> and hauling of the ash. <br /> Contractor shall load and deliver any ash used by City for its own needs <br /> free of charge if such delivery is made within one (1) track mile of the incinera- <br /> tor. Contractor shall load and deliver any ash used for these same needs in excess <br /> -8- <br />
