to inspect and to make tests upon the garbage and refuse disposal facility of the <br /> City, and the operation and maintenance thereof, to determine whether or not the <br /> provisions of this agreement are being complied with. Nothing herein shall be <br /> construed as a limitation upon the power and authority of public health officers <br /> to make such inspections and/or tests pursuant to State or local regulations. <br /> 9. The City hereby covenants and agrees that during the term of this <br /> agreement it will in no way compete with Contractor in the garbage or refuse <br /> disposal business nor will it enter into any agreements similar to this with com- <br /> petitors of Contractor. The City reserves the right to retain garden refuse <br /> materials for its own purposes. <br /> 10. The City hereby grants to Contractor, for the term of this agreement <br /> the exclusive right, license and privilege of retaining all salvage in connection <br /> with all garbage and refuse belonging to or handled by the City or its contractual <br /> agents or independent contractors. <br /> 11. (a) The City agrees to pay the Contractor eighty-four thousand <br /> dollars ($84,000.00) per year during the term of this agreement at the rate of <br /> seven thousand dollars ($7,000.00) per month commencing on the 20th day of the <br /> second month following the beginning of the operation and maintenance of said <br /> garbage and refuse disposal facility by Contractor. It is expressly understood <br /> that each month's payment is in consideration of the operation and maintenance of <br /> the garbage and refuse disposal services provided by the Contractor during the <br /> preceding month. Said payments shall entitle City, its authorized collectors and <br /> agents to dispose of an average of twenty-eight thousand (28,000) cubic yards of <br /> uncompacted garbage and refuse each month. Any garbage and refuse disposal by <br /> the City in excess of an average of twenty-eight thousand (28,000) cubic yards <br /> per month or an average of one thousand (1,000) cubic yards during any given day <br /> shall incur a charge of twenty-five cents per cubic yard for each cubic yard in <br /> excess of the stated amounts. <br /> It is understood that after two (2) years from the date of the signing <br /> of this agreement all rates under this agreement shall be subject to change, from <br /> time to time, by mutual consent of the parties, based on business conditions in <br /> general, including the cost of equipment, labor and materials, and rates which <br /> -7- <br />
