Diepenbrock F i–,- <br /> Arcady Oil Company <br /> 1515 Hope Street, Suite 202 <br /> Pasadena, CA 91030 <br /> SOLID WASTE ASSESSMENT TEST (SWAT) REPORT, ARCADY OIL COMPANY, SAN JOAQUIN COUNTY <br /> I have recently been assigned lead regulatory responsibility for the Arcady Oil <br /> Company drilling mud disposal facility. In reviewing the files I found that <br /> Arcady is in violation of Water Code Section 13267, for failure to complete a <br /> SWAT report. Therefore, Arcady could be civilly liable, under Water Code Section <br /> 13268, for an amount not to exceed one thousand dollars ($1 ,000) for each day <br /> in which the report was not completed. <br /> In a letter dated 6 April 1988, Arcady was notified of the minimum tasks required <br /> to complete the SWAT report by 1 July 1988. There was no response. In a letter <br /> dated 31 August 1989, Arcady was notified that the report was delinquent, and <br /> that enforcement actions were possible. Again there was no response. <br /> We are now considering enforcement actions which could include either an <br /> Administrative Civil Liability (ACL) , or a Cleanup and Abatement Order. What <br /> is Arcady's position with regard to compliance with the SWAT program? We would <br /> appreciate a response to this question prior to any decision on our part to <br /> pursue an enforcement action.
