Diepenbrock <br /> Arcady Oil Company <br /> 1515 Hope Street, Suite 202 <br /> South Pasadena, CA 91030 <br /> ARCADY OIL COMPANY, HOLT, SAN JOAQUIN CO. , SURFACE IMPOUNDMENT <br /> CLOSURE, TPCA ##05137 <br /> Based on a waste characterization from 1984, we have determined <br /> that you have hazardous wastes surface impoundment(s) at your <br /> facility which are regulated by the Toxic Pits Cleanup Act <br /> (TPCA) . Your consultant, Condor Environmental Management, is <br /> currently analyzing additional waste samples to refute the 1984 <br /> results. Should the current waste characterization verify that <br /> you are regulated under the TPCA, you must cease discharge to <br /> these surface impoundments by 1 July 1988 and close the <br /> impoundments in accordance with a schedule to be approved by the <br /> Regional Board. Attachment 1 describes the difference between <br /> closure and "cease discharge". <br /> Closure of your surface impoundment is regulated by the <br /> California Administrative Code (CAC) , Title 22, Chapter 30, <br /> Division 4, commencing with Section 67210; by CAC, Title 23, <br /> Chapter 3, Subchapter 15, commencing with Section 2580: and, <br /> potentially, under the Resource Conservation and Recovery Act <br /> (RCRA) , by the Code of Federal Regulations, Title 40, Part 264, <br /> Subpart G, or Part 265, Subpart G as appropriate. Before you <br /> begin closure, we require that you submit to us a closure plan <br /> for approval which complies with these regulations, as <br /> appropriate, and which includes a time schedule to complete <br /> closure activities. If you cannot "clean close" your impoundment <br /> (that is, remove all residual waste and contamination) then we <br /> require that you submit to our office not only a plan for post- <br /> closure activities, but also, pursuant to Section 13260 of the <br /> Water Code, a Report of Waste Discharge. Enclosed are guidelines <br /> for the preparation of your closure plan (Attachment 2) , post <br /> closure plan (Attachment 3) and a Report of Waste Discharge form <br /> (Attachment 4) . If you suspect your facility is regulated by <br /> RCRA, please contact us for additional closure instructions. If <br /> you determine that you are not regulated by RCRA, then you should <br /> provide appropriate rationale and supporting argumentsin your <br /> closure plan. <br /> Both the Regional Board and the Department of Health Services <br /> regulate the closure of surface impoundments.
