Mr. Alex J. Diepenbrock -2- 27 October 1987 <br /> . that the Board will act as the lead agency for site closures <br /> under TPCA. As lead, the Board will regulate your activities to <br /> close the impoundments as defined by the TPCA in Section <br /> 25208.2 (d) of the Health and Safety Code. The Board also will <br /> coordinate its comments on your closure plan with those of the <br /> Department, and will send out letters which include the comments <br /> or approval of both agencies. However, the Department, as well <br /> as the Board, reserve their independent authorities to take <br /> enforcement action where necessary. Furthermore, if your site is <br /> ranked on the State priority list for removal and remedial <br /> action, then the Department will retain its lead responsibilities <br /> for site mitigation. If you are currently working with both the <br /> Department and Regional Board staffs on your project, you should <br /> continue to work with both agencies to comply with their <br /> respective regulations pertaining to closure or site mitigation. <br /> Under our authority in Section 13267 of the Water Code we require <br /> that you furnish two copies of the following technical. reports: <br /> 1) closure plan, 2) post-closure plan, and 3) report of waste <br /> discharge, if appropriate, to be received in this office no later <br /> than 31 December 1987 . We will forward a copy to the Department <br /> for their review and comment. <br /> Questions regarding the Department's closure policy and <br /> requirements for closure plans should be addressed to Don <br /> Shaulis, Department of Health Services, Toxic Substances Control <br /> Division, Northern California Section, 4250 Power Inn Road, <br /> Sacramento, CA 95826.
