Diepenbrock Pvv1po 190 <br /> Arcady Oil Company <br /> 1515 Hope Street, Suite 202 1T/ / <br /> South Pasadena, CA 91030 VFS <br /> ARCADY OIL COMPANY, SAN JOAQUIN COUNTY <br /> On 1 October 1984 Arcady Oil Company was issued a Cleanup and <br /> Abatement Order, requiring 1) an investigation to assess the <br /> extent of Group 1 wastes (hazardous and designated wastes, as <br /> defined in California Administrative Code, Title 23 , Chapter 3, <br /> Subchapter 15, adopted 18 October 1984) deposited at the site, <br /> and the extent of contamination in surrounding soils and <br /> groundwater, and 2) the development and implementation of an <br /> action plan, including cleanup and abatement measures. At this <br /> date Arcady has neither performed the investigation nor developed <br /> and implemented an action plan in accordance with the ordered <br /> deadlines. <br /> On 6 January 1987 we sent you a letter stating the requirements <br /> of the Toxic Pits Cleanup Act (TPCA) (Article 9 .5, Chapter 6. 5, . <br /> Division 20 of the Health and Safety Code) . The letter requested <br /> submittal of the following: <br /> 1. Fees required by Section 25208.3 (e) within 60 days, <br /> 2. Workplan (technical report) developed to meet the HAR <br /> requirements by 27 February 1987, and <br /> 3. A Hydrogeologic Assessment Report (HAR) , pursuant to <br /> Section 25208.7 by 1 June 1987 . <br /> On 13 February 1987 we sent you a letter informing you that Water <br /> Code Section 13273 requires operators of active and inactive <br /> solid waste disposal sites to perform a Solid Waste Water Quality <br /> Assessment Test (SWAT) to determine if 'hazardous waste' is <br /> leaking from the waste management unit. The SWAT proposal for <br /> Arcady Oil Company was due 1 April 1987. The final SWAT report <br /> is due 1 July 1988. <br /> Aside from your company representatives meeting with staff on 9 <br /> March 1987 to discuss the various regulatory programs and how <br /> they overlap, you have not responded to our requests for <br /> information pursuant to the TPCA or Water Code Section 13273 , and <br /> you have demonstrated no progress to comply with the Cleanup and <br />
