Mr. Alex J. Diepenbrock -2- 6 August 1987 <br /> Abatement Order. <br /> We are aware of the work being conducted at the northern end of <br /> the facility by Southern Pacific . 'to assess the extent of <br /> contamination of gasoline from a pipeline rupture. We intend to <br /> require Southern Pacific to continue their work in an expeditious <br /> manner. However, the fact that SP is responsible for a site <br /> investigation on Arcady oil Company's property does not relieve <br /> you of the responsibility to comply with the TPCA, Water Code <br /> Section 13273, or your Cleanup and Abatement Order. <br /> Arcady Oil Company has failed to meet the administrative <br /> deadlines for compliance with the TPCA, the SWAT proposal, and <br /> the Cleanup and Abatement Order. Time for you to meet the <br /> statutory deadlines imposed by the TPCA is also expiring. We <br /> therefore request, pursuant to Sections 13267 and 13273 of the <br /> California Water Code, and Section 25208.7 of the TPCA that you <br /> submit the following: <br /> 1. Plan (technical report) by 21 August 1987 for conducting <br /> additional waste characterization to determine the presence <br /> of hazardous wastes from the disposal of drilling muds (see <br /> Attachment 1 for further discussion) ; <br /> 2.. . Technical report by 21 September 1987 with results of <br /> additional waste characterization; <br /> 3 . Fees required by Section 25208. 3 of the TPCA Fees <br /> requested in the 6 January 1987 letter are now subject to a <br /> 100-percent penalty. Arcady was also notified by the State <br /> Water Resources Control Board on 4 June 1987 of annual fees <br /> for 1987-88 that were due within 60 days of the date of <br /> their letter; <br /> 4. HAR and SWAT workplans (technical reports). by 1 October <br /> 1987. The information requirements of the two reports <br /> overlap. Attachment 2 contains tables showing the overlap. <br /> Information developed for the HAR can be used for the SWAT <br /> to the extent that it complies with both regulations; <br /> 5. Plan (technical report) by 1. November 1987 for complying <br /> with the 'cease discharge' deadline of 30 June 1988 in the <br /> TPCA (See Attachment 3 for further information on ceasing <br /> discharge and closing TPCA surface impoundments) ; <br /> 6. A HAR by 31 December 1987; and <br /> 7. A SWAT report by 1 July 1988. <br />
