WHEREAS, notice of the hearing was duly given as required <br />by law and by resolution of this Board of Supervisors adopted <br />June 1, 1976, as shown by proof of publication filed this day <br />with this Board of Supervisors; and, <br />WHEREAS, Robert F. Thoreson, City Director of Public <br />Works, was present at the hearing representing the city of <br />Stockton; and, <br />WHEREAS, no protests or objections, either written or <br />oral, were filed or made against said proposed annexation; <br />This Board does now FIND that said territory sought to <br />be annexed to the City of Stockton meets the requirements for <br />annexation set forth -in Sections 35200-35213, inclusive, of the <br />Government Code of the State of California in that said terri- <br />tory.is not contiguous to the city of Stockton, does not exceed <br />100 acres in area, has no registered voters residing therein or <br />thereon, lies entirely within the County of San Joaquin in which <br />County <br />.,the City of Stockton is situated, and is owned by the City <br />of Stockton and used by it for a municipal purpose, to wit, sani- <br />tary disposal site; <br />NOW, THEREFORE, this Board, having considered the <br />evidence, both oral and documentary, in regard to this matter, <br />does hereby determine and it is hereby resolved and ordered, upon <br />the complete record, that the real property owned by the City of <br />Stockton and commonly known as the "Austin Road Waste Disposal <br />Site Annexation - A-1-76" shall be, and it is hereby, annexed to <br />the City of Stockton, a Municipal Corporation of the State of <br />California, pursuant to the provisions of Sections 35200-35213, <br />inclusive, of the Government Code of the State of California. <br />BE IT'FURTIIER RESOLVED that the real property hereby <br />annexed to the City of Stockton is described as set forth in <br />Exhibit A attached hereto and made a part hercof and is shown on <br />map 111,1r1red Exhibit B attached hereto and inade a part hereof. <br />BE IT FURTHER 1U:'SOLV1,,'D that the Clerk of this hoard shall <br />enter this resolution upon the minutes of this Board and shall. <br />- 2 - <br />
