WASTE DISCHARGE REQUIREMENTS -3- <br /> CITY OF STOCKTON <br /> AUSTIN ROAD LANDFILL <br /> GROUND WATER TREATMENT SYSTEM AND STORM WATER DISCHARGE <br /> SAN JOAQUIN COUNTY <br /> 10. The Board adopted a Water Quality Control Plan, Second Edition, for the <br /> Sacramento-San Joaquin Delta Basin (5B) (hereafter Basin Plan) which <br /> contains water quality objectives for all waters of the Basin. These <br /> requirements implement the Basin Plan. <br /> 11 . The beneficial uses of the San Joaquin River and the Sacramento-San Joaquin <br /> Delta downstream of the discharge are municipal , industrial , and <br /> agricultural supply; water contact and noncontact recreation; aesthetic <br /> enjoyment; navigation; fresh water replenishment; and preservation and <br /> enhancement of fish, wildlife and other aquatic resources. <br /> 12. The beneficial uses of groundwater are municipal , industrial , and <br /> agricultural supply. <br /> 13. The Board has considered antidegradation pursuant to 40 CFR 131.12 and <br /> State Water Resources Control Board Resolution 68-16 and finds that the <br /> permitted discharge is consistent with those provisions. <br /> 14. Water Quality Objectives adopted pursuant to the Inland Surface Waters Plan <br /> and the Enclosed Bays and Estuaries Plan, adopted by the State Water <br /> Resources Control Board are applicable to the discharge. These <br /> requirements implement the Plans. <br /> 15. Effluent limitations, and toxic and pretreatment effluent standards <br /> established pursuant to Sections 301, 302, 304, and 307 of the Clean Water <br /> Act (CWA) and amendments thereto are applicable to the discharge. <br /> 16. The action to adopt an NPDES permit is exempt from the provisions of the <br /> California Environmental Quality Act (CEQA) (Public Resources Code Section <br /> 21000, et seq.) , in accordance with Section 13389 of the California Water <br /> Code. <br /> 17. The Lead Agency, the City of Stockton Community Development Department, <br /> issued a Notice of Exemption for this project dated 2 March 1992. The <br /> basis for finding for exemption was that the activity constitutes a <br /> discretionary project under the City's jurisdiction and qualifies as a <br /> project which has been determined not to have a significant effect on the <br /> environment and, therefore, is exempt from the provisions of CEQA under the <br /> Statutory Exemption under Section 152609, Article 18 of Title 14 of the <br /> California Code of Regulations (CCR) and Categorical Exemption under <br /> Sections 15301(d)&(f) , 15307, 15308, 15321, Article 19 of Title 14 CCR. <br /> 18. The Board has notified the Discharger and interested agencies and persons <br /> of its intent to prescribe waste discharge requirements for this discharge <br /> and has provided them with an opportunity for a public hearing and an <br /> opportunity to submit their written views and recommendations. <br />
