El Dorado Street <br /> Stockton, CA 95202-1997 <br /> Subject: Draft Documents Establishing an Enterprise Fund as a <br /> Financial Assurance Mechanism for Closure and <br /> Postclosure Maintenance Costs of Austin Road Landfill, <br /> Facility No. 39-AA-0001 <br /> Dear Mr. Chen: <br /> The Financial Assurances Section has completed its evaluation of <br /> the referenced draft documents submitted by the City of Stockton <br /> to provide financial assurance for closure and postclosure <br /> maintenance costs of Austin Road Landfill, Facility No. 39-AA- <br /> 0001. I have the following specific comments regarding <br /> Paragraphs 3 and 7, and the attest language, and suggest the <br /> following changes which Board staff believe will more clearly <br /> insure that the requirements of Title 14, California Code of <br /> Regulations (CCR) , Division 7, Chapter 5, Article 3 . 5, section <br /> 18285 are met. Please refer to the Enterprise Fund packet that I <br /> am enclosing, particularly for the attest language. <br /> Paragraph 3 <br /> That the funds referred to in Section 2 above shall be <br /> deposited and retained by the Finance Director of the City <br /> of Stockton in a separate fund to be known as the Austin <br /> Road Landfill Closure/Postclosure Maintenance Fund and shall <br /> be used to pay only for closure and postclosure maintenance <br /> of the Austin Road Landfill. <br /> Paragraph 7 <br /> That in the event the California Integrated Waste Management <br /> Board determines that the City has failed to perform closure <br /> and/postclosure maintenance as required by law, the Board <br /> may direct the City Finance Director to pay, from the Austin <br /> Road Landfill Closure/Postclosure Maintenance Fund to the <br /> Public Works Director such amounts as are necessary for the <br /> Printed on Recycled Paper— <br />
