Mr. Chen
City of Stockton
Page 2
closure or postclosure maintenance in accordance with the
directives of the Board.
Attest Language
Please include the attest language on page 3 of the sample
Resolution with the City Clerk's attest.
In addition, please refer to the Enterprise Fund packet for the
sample letters that are also required by 14 CCR section 18285.
The two required letters are a letter from the operator and a
letter from the treasurer.
The letter from the operator or agency providing financial
assurance is required to explain to the Board the
responsibilities and interrelationships of the various local
parties involved in the operation of the landfill. This letter
should also indicate the sources and holders of all funds that
will be deposited.
The letter from the treasurer is required to demonstrate that the
appropriate depository mechanism within the enterprise fund has
actually been established. This is a letter to the Board,
typically from a county/city treasurer or auditor/controller,
stating that the depository mechanism has been created and
reiterating his/her intention to comply with the conditions set
forth in sections 18285 (b) (1-6) . These are the provisions that
make this instrument a viable assurance mechanism.
Thank you for your cooperation. I anticipate receiving the final
documents in the near future. Please call me at (916) 255-2441
if you need any additional assistance.
Sincerely,
® n
Nancy Jestreb
Financial Assurances Section
Enclosure
cc: Ed Padilla, San` Joaquin 'County Environmental Health Division
Phil Moralez, Permits Branch, CIWMB
Michael Wochnick, Closure Section, CIWMB
