Section 258.28 (a) (2) of
Subtitle D states:
Bulk or noncontainerized liquid waste may not
be placed in MSWLF units unless the waste is
leachate or gas condensate derived from the
MSWLF unit and the MSWLF unit, whether it is a
new or existing MSWLF, or lateral expansion,
is designed with a composite liner and
leachate collection system as described in
Section 258.40 (a) (1) of this part. )
October 9, 1993 (effective date of Subtitle D Final Rule)
will be used as the date certain for prohibiting the
continued disposal of all landfill gas condensate into
the Austin Road Landfill Site. Testing results will
determine if an alteration in the 10/9/93 date
certain is required.
b. A report delineating disposal options for
the landfill gas condensate to be submitted by
the, operator to your office, the RWQCB, and
Board.
c. A report specifying the preferred disposal
method and quarterly reports thereafter
demonstrating the operator's progress in
initiating this method.
The compliance agreement should contain a date certain
for the completion of each milestone mentioned above.
The compliance agreement should outline a time frame for
implementation along with subsequent enforcement actions
that your agency will enact if the terms and conditions
