Compliance Agreement- Leachate Control Page 2 <br /> Austin Road Landfill Site, 39-AA-0001 <br /> 2. Your agency will take the lead role in drafting and <br /> enacting a compliance agreement that prohibits the <br /> continued disposal of all landfill gas condensate into <br /> the Austin Road Landfill Site. (Note: As you are aware, <br /> the Resource Conservation and Recovery Act (RCRA) <br /> Subtitle D Final Rule for Municipal Solid Waste Landfills <br /> (MSWLFs) has been issued. The effective date of the <br /> Final Rule is October 9, 1993 . Section 258.28 (a) (2) of <br /> Subtitle D states: <br /> Bulk or noncontainerized liquid waste may not <br /> be placed in MSWLF units unless the waste is <br /> leachate or gas condensate derived from the <br /> MSWLF unit and the MSWLF unit, whether it is a <br /> new or existing MSWLF, or lateral expansion, <br /> is designed with a composite liner and <br /> leachate collection system as described in <br /> Section 258.40 (a) (1) of this part. ) <br /> October 9, 1993 (effective date of Subtitle D Final Rule) <br /> will be used as the date certain for prohibiting the <br /> continued disposal of all landfill gas condensate into <br /> the Austin Road Landfill Site. The compliance agreement <br /> will contain "milestones" that will assure your agency <br /> and the Board that the operator is making diligent <br /> progress toward this end. Milestones discussed included: <br /> a. Testing to determine if the landfill gas <br /> condensate is a "hazardous" waste using <br /> criteria for identification specified in CCR, <br /> Title 22, Article 11. Testing results will <br /> determine if an alteration in the 10/9/93 date <br /> certain is required. <br /> b. A report delineating disposal options for <br /> the landfill gas condensate to be submitted by <br /> the, operator to your office, the RWQCB, and <br /> Board. <br /> c. A report specifying the preferred disposal <br /> method and quarterly reports thereafter <br /> demonstrating the operator's progress in <br /> initiating this method. <br /> The compliance agreement should contain a date certain <br /> for the completion of each milestone mentioned above. <br /> The compliance agreement should outline a time frame for <br /> implementation along with subsequent enforcement actions <br /> that your agency will enact if the terms and conditions <br />
