TAL� HEALTI-A <br />RE: Daily tonnage allowed at the Austin Road Landfill <br />Facility No. 39 -AA -0001 <br />Dear Mr. Cope: <br />GEORGE DEUKMEiIAN, Governor <br />This letter serves as a response to your October 5 and November <br />3, 1989 letters to Martha Vazquez of my staff. In those letters <br />you requested consideration of an increase in the amount of waste <br />the Austin Road Landfill can receive each day. After reviewing <br />the information which you have provided, and after consultation <br />with the Local Enforcement Agency (LEA), it is our opinion that <br />the maximum amount of waste the facility can receive within the <br />confines of a permit modification is 512 tons of waste per day. <br />Our position is based on language included in the 1977 Solid <br />Waste Facilities Permit (SWFP), and an agreement made during a <br />meeting held on May 24, 1989 and attended by representatives of <br />the City of Stockton Public Works (see attached letter). As you <br />are aware, the 1983 SWFP limited the facility to receipt of 280 <br />tons of waste per day. The LEA has been quite flexible and is <br />willing to allow the facility to receive the larger tonnage <br />figure stated in the 1977 SWFP. The 1977 SWFP states the <br />facility receives 605,796 cubic yards per year, which is <br />approximately 512 tons of waste per day. The tonnage was <br />calculated using a five day operating week and a conversion <br />factor of 440 pounds per cubic yard. The five day operating week <br />is stated in both the 1983 and 1977 SWFPs, and the conversion <br />factor was provided by the City of Stockton in a letter dated <br />March 1, 1989. <br />The assertion that the tonnage figures projected in the 1977 <br />Report of Disposal Site Information (RDSI) should be considered <br />as the maximum daily tonnage limit is not correct. The tonnage <br />figure reflected in the current 1983 SWFP is the amount <br />enforceable by the LEA and this Board. <br />Changes to the SWFP which are ministerial or not significant, can <br />be addressed with a permit modification. Increasing the tonnage <br />to 512 tons of waste per operating day with a modification of the <br />Austin Road Landfill permit is appropriate because the facility <br />was previously permitted to accept that amount.
