Market Boulevard <br />Sacramento, CA 95834 <br />Subject: Austin Road Landfill, Facility No. 39 -AA -0001 <br />Dear Mr. Copes <br />This responds to your November 29, 1989 letter requesting the <br />California Waste Management Board (CWMB) resolve -a disagreement <br />between the City of Stockton and the San Joaquin.County Local <br />Enforcement Agency over the tonnage allowance at the Austin Road <br />Landfill. <br />Although Board staff have expressed their support pport of the LEA's <br />position, it would-be inappropriate for the CWMB to consider this <br />issue until the prescribed local appeal process had been <br />exhausted. Specifically, this matter should be considered <br />by the local hearing panel appointed pursuant to Government <br />Code Section 66796.58 (Public Resources Code Section 44800` <br />after January 1, 1990) The CWMB would be the appeal body for <br />any decisions of the local hearing panel. <br />If you have any questions, please call me at (916) 327-0440, <br />Sincerely, <br />Don Dier Jr., P.
