responsible for obtaining a] -1 -permits or incremental permits <br />required to operate LANDFILL OWNER's Collection System or any <br />portion thereof. In addition, PEn shall repair, maintain, <br />operate, relocate, and replace that portion of LANDFILL <br />OWNER's Collection System to the same extent and with the same <br />degree of care, responsibility, and authority as PEn exercises <br />in performing such function with regard to its own Collection <br />System(s) . Such repairs, maintenance, operation, relocation, <br />or replacement shall meet any regulations imposed by the <br />federal government, the State of California, or any other <br />agency having regulatory jurisdiction over such operations. <br />With regard to any portion of LANDFILL OWNER's Collection <br />System which PEn elects not to use, LANDFILL OWNER shall use <br />its best efforts to avoid operating such portion of its <br />Collection System if PEn determines that such operation by <br />LANDFILL OWNER would significantly diminish the landfill gas <br />reservoir, reduce the flow rate of landfill gas recoverable by <br />PEn's Collection System, or would otherwise interfere or <br />prevent PEn from recovering • •. in paying quantities. <br />• shall • LANDFILL • fifteen (15) • (or as many <br />•. as may •- practicable •- the circumstances) advance <br />written notice of any determination made by PEn that LANDFILL <br />• I s operation • • • I s Collection System • <br />be restricted or terminated.
