with any rule, order, or regulation established by any <br />government or other agency having regulatory jurisdiction over <br />the landfill. <br />If PEn elects to use all or any portion of LANDFILL <br />#WNER's Collection System and LANDFILL OWNER subsequently <br />tetermines that such portion of the LANDFILL OWNER's Collec- <br />tion System installed by it must be operated at a higher draw <br />rate as a result of either any order or regulation imposed by <br />any government or other agency having jurisdiction over the <br />landfill or as the result of verified complaints received by <br />LANDFILL OWNER that landfill gas is migrating to adjacent <br />properties or if LANDFILL OWNER is notified that PEn's <br />operations or PEn's repairs, maintenance, operation, relo- <br />cation, or replacement of such system fail to meet any <br />regulation imposed by federal, state, or other regulatory <br />agencies having jurisdiction over such operations, LANDFILL <br />OWNER may request, in writing, that PEn increase the draw rate <br />on wells constituting LANDFILL OWNER's Collection System or <br />take whatever measures are necessary to cause PEn's operation <br />to comply with federal, state, or local regulations.
