However, neither party shall hlave been deemed to have waived or altered any of the right or obligations pursuant to Sections 11 and 19.02 of the original Agreement executed on August 27, 1982, through such coopera- tion. 2.09. PEn agrees to gather and handle the disposition of any landfill gas condensate collected within PEnIs Collection System which has been collected in conjunction with the landfill gas to be utilized by PEn's Conversion system. The disposition of the condensate shall be in accordance with the regulations imposed by the federal government, the State of California and any other agency having regulatory jurisdiction over such operations. PEn shall have no obligation of any nature with respect to the monitoring, collection, control, or disposal of any landfill gas condensate produced by the Landfill, except as directly generated by PEn through the operation of its Collection System or Systems referred herein. Furthermore, except as to gas condensate collected within PEnIs Collection System, PEn expressly disclaims any and all liability, responsibility, representation, guarantee or warranty, whether expressed or implied, with respect to any landfill gas condensate from the Landfill, and the Landfill Owner hereby agrees to defend, indemnify and hold PEn harmless from and against any and all claims, liabilities, causes of action, demands, losses or expenses, including attorneys' fees, arising out of any claim from a third party as a result of any 2
