of its Collection System(s) , then PEn shall disconnect <br />LANDFILL OWNER's Collection System in whole or in part, <br />depending upon what is necessary to gain compliance with said <br />regulations, from PEn's Collection System as expeditiously as <br />&ossible and use diligent efforts to return such portion of <br />LANDFILL OWNER's Collection System(s) to the original condi- <br />tion, or, at a minimum, to the original condition, normal wear <br />and tear excepted. Following any such disconnection or resto- <br />oration, LANDFILL OWNER shall assume the sole responsibility <br />f or any such portion of LANDFILL OWNER I s Collection System <br />including operation, maintenance, and repair. <br />If, during the term of this Lease, LANDFILL OWNER <br />operates LANDFILL OWNER's Collection System, PEn shall have <br />the right to receive from LANDFILL OWNER, for use in PEn's <br />Conversion System, the Landfill Gas collected by LANDFILL <br />OWNER's Collection System. To the extent that LANDFILL OWNER <br />collects Landfill Gas in order to comply with any rule, order, <br />or regulation of any governmental or regulatory agency and <br />flares or otherwise utilizes the gas for LANDFILL OWNER's own <br />incidental parasitic usage directly related to such flaring, <br />PEn will not require compensation for Landfill Gas so <br />utilized. However, PEn shall be compensated by LANDFILL OWNER <br />if any Landfill Gas collected by LANDFILL OWNER is trans- <br />ferred, sold or utilized for purposes other than flaring or <br />such incidental uses as identified above.
