Box 2009 <br />Stockton CA 95201 <br />N 0 V z o 19089 <br />ENVIRONMENTAL HFALT�-I <br />PERMI T/�S <br />AUSTIN ROAD LANDFILL --MAXIMUM DAILY CAPACITY OF 512 TONS <br />This is in response to your letter of October 27, 1989, <br />concerning the maximum daily capacity of 512 tons at the Austin <br />Road landfill. You required the City within 30 days to reduce <br />the daily tonnage to 512 tons or our permit would be "suspended, <br />or revoked." <br />It is the City's position that the maximum daily capacity should <br />be 776 tons (attached letter to the California Waste Management <br />Board of October 5, 1989). Our opinion is that the quantity of <br />wastes presently received does not constitute a significant <br />change in operations because the volume is substantially less <br />than what was forecast in the 1977 Report of Disposal Site <br />Information (RDSI). The 1977 RDSI was referenced in both the <br />1977 and 1983 Solid Waste Facility Permits (SWFP) to characterize <br />site operations. The City maintains that we should be permitted <br />to receive the quantities which were forecast in the original <br />RDSI. Since the City intends to appeal this issue before the <br />California Waste Management Board at the December meeting, if <br />necessary, your office should have granted us the courtesy of <br />delaying action on this matter until after the meeting. <br />Since you afforded the City no option, we reluctantly will limit <br />the daily tonnage at the Austin Road landfill to 512 tons (see <br />attached letter that we plan to send to all haulers on <br />November 20, 1989).
