The leachate in question was <br /> initially cited as an area of concern on the April 12 , 1996 <br /> inspection. A written management plan was requested at that <br /> time, as the leachate flow was discharging into the drainage <br /> ditch to the north side of the landfill (outside of the permitted <br /> landfill footprint) . No plan was submitted prior to the May 9, <br /> 1996 inspection. At that time the leachate continued to surface <br /> and flow as noted in the inspection, and documented by pictures <br /> taken during that same inspection. The area of concern was <br /> elevated to a violation as is the custom for an uncorrected <br /> matters, as the problem continued. <br /> The June 7, 1996 inspection revealed that the leachate flow had <br /> not been controlled and was draining across the access road to <br /> the working face of the landfill, as documented by photographs. <br /> In addition there was methane gas being generated at levels of <br /> 400 ppm to 600 ppm, at the surface of the ground. This <br /> inspection followed a week of over 100 degree weather at the site <br /> and there was still a leachate flow. Covering the leachate with <br /> dirt has lead to the ground becoming saturated and no longer able <br /> to support the weight of equipment or personnel. <br /> As indicated in your letter the document you quoted is a guidance <br /> document and does not cover all possible scenarios. Until the <br /> leachate flow is controlled in a manner which confines it in a <br /> way that will not impact equipment or pose a threat to personnel, <br /> it will continue as a violation. <br /> If you have any questions please contact Steven Mindt, Sr. REHS, at <br /> (209) 468-0343 of my staff. <br /> Ernest M.
