Mr. Scott Walker <br />March 25, 1996 <br />Page 3 <br />winterization plan, Gambi believed its use was permitted. However, when visqueen was <br />first used in January and the LEA objected, its use was promptly discontinued. The City <br />considered this a simple issue of miscommunication. The minor nature of this problem is <br />supported by the fact that none of the weekly or monthly inspection reports notes a violation, <br />concern, or comment about the visqueen. <br />Item #3 concerns a problem with litter. It should be noted that not one of the four monthly <br />inspection reports covering both landfills for the January/February period indicates a <br />violation for litter control. In fact, these monthly reports do not even indicate that litter is <br />an area of concern. The weekly inspections reports note that litter is only "light", "low", or <br />"very light" and also note that there were "persons picking up litter" and that "litter fences <br />are up and functioning well." A thorough review of all of the inspection reports show no <br />indication that litter is a problem and does not support the LEA's Report. <br />Item #4, states "incidences of landfill maintenance neglect ... have increased." Again, not <br />one of the four monthly inspection reports indicates a violation for any of the State standards <br />of compliance. Again, the LEA's own inspection reports do not support the conclusion that <br />landfill maintenance is being neglected. <br />Finally, the "Conclusion" portion of the Report reviews the same issues noted above and suggests <br />that the City terminate the demonstration project. As stated above, and as supported by the LEA's <br />weekly and monthly inspection reports, the City believes the project is going well and intends to <br />continue because of its importance in meeting State -mandated diversion requirements. <br />In conclusion, the City would like to reiterate its objection to the Report and its unsupported <br />conclusions. A meeting was held on March 25, 1996 with the LEA to discuss this issue. We would <br />like to invite you to come to Stockton and visit both landfills to see how well the operations and <br />project are proceeding.
