Resolution No. <br />210� <br />STOCKTON CITY COUNCIL <br />RESOLUTION OF THE CITY OF STOCKTON FINDING AND DETERMINING THE <br />PUBLIC NECESSITY REQUIRES THE ACQUISITION OF CERTAIN REAL PROPERTY <br />INTERESTS FOR A PUBLIC PROJECT AND DIRECTING THE ACQUISITION OF <br />SAID REAL PROPERTY INTERESTS BY EMINENT DOMAIN PROCEEDINGS. <br />WHEREAS, the city of Stockton is a chartered municipal <br />corporation and one of the public entities authorized to exercise <br />the power of eminent domain; and <br />WHEREAS, Section 37350.5 of the Government Code <br />authorizes the City of Stockton to acquire by eminent domain any <br />property necessary to carry out its powers and functions; and <br />WHEREAS, one of the powers and functions of the City of <br />Stockton is to provide solid waste disposal services to the <br />community; and <br />WHEREAS, Section 38790 of the Government Code authorizes <br />the City of Stockton to acquire property for the purpose of solid <br />waste disposal; and <br />WHEREAS, the interests in certain real property located <br />in Stockton, California (the "Property"), as described in Exhibit <br />"All attached and incorporated by reference, are necessary for the <br />construction of a landfill/solid waste disposal facility, the <br />Austin Road Landfill Expansion Project (the "Proposed Project") , <br />which will allow the City to carry out its role of providing solid <br />waste disposal/landfill services to the residents of Stockton; and <br />WHEREAS, written notice of the intent of the City of <br />Stockton to adopt this Resolution of Necessity was sent to the <br />owners of the properties whose names and addresses appear on the <br />last equalized county assessment roll; and <br />WHEREAS, written requests to appear were received from <br />no one ; and <br />CITY ATTR ., A <br />REVIEW, ;37*orl ....
