WHEREAS, a hearing was conducted and all interested <br />persons were given an opportunity to be heard; <br />NOW, THEREFORE, based on the evidence presented, <br />BE IT FOUND, DETERMINED AND RESOLVED BY THE COUNCIL OF <br />THE CITY OF STOCKTON, AS FOLLOWS: <br />1. That the Property to be acquired is described in <br />Exhibit "A," attached and incorporated by this reference. <br />2. That the Property is to be acquired for a public use <br />and a public project, the construction and installation of solid <br />waste disposal and landfill facilities pursuant to the authority <br />granted by Sections 37350.5 and 38790 of the Government Code, <br />Section 40057 of the Public Resources Code and Section 1230.010, et <br />seq. of the Code of Civil Procedure. <br />3. That the public interest and necessity require the <br />acquisition, construction and installation of the Proposed Project. <br />4. That the Proposed Project is planned and located in <br />the manner which will be most compatible with the greatest public <br />good and the least private injury. <br />5. That the Property, as described in Exhibit "A," is <br />necessary for the Proposed Project. <br />6. That the amount of compensation believed to be just <br />has been determined and an offer in such amount and the basis <br />therefor has been made to the owners of record as required by <br />Government Code section 7267.2. <br />7. That the City Attorney is hereby authorized and <br />empowered: <br />(a) To acquire in the City, s name, by condemnation, <br />the Property in accordance with the provisions the Eminent Domain <br />Law of the Code of Civil Procedure and the Constitution of <br />California; <br />(b) To prepare and prosecute in the City, s name <br />such proceedings in the proper court as are necessary for such <br />acquisition; <br />2 <br />
