1 amount of compensation that will be awarded in this proceeding. Said <br />2 amount is based upon the appraisal by Ronald L. Palmquist, Senior <br />3 Real Property Agent for the City of Stockton, whose declaration and <br />4 written summary of the basis of the appraisal have been filed with <br />5 this court. <br />6 3. Upon order of the court fixing the probable amount of <br />7 compensation, plaintiff will deposit said amount with the San Joaquin <br />8 County Treasurer in accordance with the provisions of Code of Civil <br />9 Procedure section 1255.010(a) and section 1255.070. <br />10 4. Plaintiff requires possession of the property described in <br />11 the complaint. Plaintiff is a municipal corporation created under <br />12 the laws of the State of California. Plaintiff is authorized and <br />13 empowered to bring a condemnation proceeding to acquire private <br />14 property for public use pursuant to Government Code sections 37350.5 <br />15 and 38790 and title 7 of part III of the Code of Civil Procedure <br />16 section 1230.010 et seq. A complaint has been filed and summons <br />17 issued herein. Judgment has not been entered. A deposit of probable <br />18 just compensation will be made in accordance with the provisions of <br />19 Code of Civil Procedure section 1255.070 in the treasury of the <br />20 County of San Joaquin. <br />21 5. Plaintiff has an urgent need for possession of the property <br />22 in that this acquisition is being made for the City of Stockton to <br />23 expand its landfill/solid waste disposal facility which is rapidly <br />24 approaching capacity. The property subject to this action is <br />25 immediately adjacent to the Austin Road Landfill and will be <br />26 incorporated therein during an approved extension project.
