Plaintiff requests the court authorize plaintiff take <br />possession of the property to be acquired 90 days after service of <br />the Order for Possession and Notice of Deposit of Probable <br />Compensation upon Brocchini Farms, Inc., the holder of fee title. <br />7. The City of Stockton respectively requests the court <br />authorize plaintiff take possession of the subject property pursuant <br />to Code of Civil Procedure section 1255.450(e) without serving a copy <br />of the Order for Possession upon those other record owners not <br />occupying possession. All named defendants other than Brocchini <br />Farms, Inc. may claim interests in a right-of-way over or mineral <br />rights within the subject property and are not readily available to <br />service. (See declaration of Janice D. Magdich, attached hereto as <br />Exhibit A and incorporated by reference as if fully set forth <br />herein.) <br />8.
