County shall not grant any right, license, privilege <br /> or permit to any person, partnership or corporation to install <br /> or operate a sanitary landfill within San Joaquin County <br /> except as provided by Ordinance No. 877 and the rules and <br /> regulations adopted by the San Joaquin Local Health District. <br /> County or any of its representatives and the San Joaquin <br /> Local Health District or any of its representatives shall have <br /> the right to inspect the operation of the sanitary landfill at <br /> any time during working hours. County or.any of its representa- <br /> tives or the San Joaquin Local health District or any of its <br /> representatives may direct t_he attention of Operator to the <br /> existence of any violation or breach of this contract. There- <br /> Upon, operator shall take such measures immediately to correct <br /> the violation or breach. <br /> Operator guarantees that the sanitary landfill site is free <br /> and clear ifrom any encumbrances whatsoever which could jeopardize <br /> his right to possession of the site or could jeopardize the <br /> operation of the sanitary landfill on, the site. Operator agrees <br /> to ensure that the sanitary landfill site shall remain free and <br /> clear of any encumbrance which could jeopardize Operator's <br /> right to possession of the site or' could jeopardize the operation <br /> of the sanitary landfill on the site and agrees to the recordation <br /> of this agreement in the Official Records of San Joaquin County <br /> as notice to the public of the obligations of Operator and of <br /> the sanitary landfill site for the duration of this agreement. <br /> -Operator guarantees the protection of the rights and privileges <br /> of County arising from this agreement- in Operator-'s_'-leases-:and--.. <br /> agreements with the owners of Parcels I and II described above. <br /> No rights, privileges or duties contained in this agreement <br /> may be delegated, assigned or subcontracted without the express <br /> F°ritten recuest" of pneratos and 'the•express•-written approval <br /> of County. <br /> - 8 - <br />
