S <br /> Aft If County and Operator have not comae to a gull and satis- <br /> factory agreement with respect to tine items provided for in the <br /> request for negotiations by tae cirst Monday in May of any year, <br /> the terms upon which agreement has not been reached s.-all be <br /> submitted to a committee of L::ve persons, two of whom shall be <br /> appointed by the Board of Supervisors and two of whom shall be <br /> appointed by the Operator, and the fifth person to be selected <br /> by the four so appointed. The findings and determination of <br /> the committee with a respect to the matters in dispute shall be <br /> transai.tted to the Board of Supervisors for such action as the <br /> Board may deem appropriate. <br /> Subsequent to a contract reopening, any new rates estab- <br /> lished shall take effect on the first Monday in May of any year <br /> in which a change of rates is made. <br /> Notwithstanding any other provision of.this article, neither <br /> party to this agreement may request reopening of this agreement <br /> until the first Monday of April 1567 unless both parties shall <br /> agree to such reopening. <br /> B. All terzis and conditions of this contract are con- <br /> sidered material and any default shall be deemed to constitute a <br /> breach of the contract unless it is expressly provided in this <br /> contract that failure to comply with or to perform a term or <br /> condition shall not constitute a breach. <br /> We , --E..
