(39 -AA -0015) on <br />the Inventory of Solid Waste Facilities Violating State Minimum Standards <br />Dear Mr. Chiapello: <br />On September 23, 2003, the California Integrated Waste Management Board (Board) sent your <br />predecessor, Mr. Kevin Basso, a Ninety -Day Notice of Intent letter to include Forward Landfill Inc. on <br />the Inventory of Solid Waste Facilities Violating State Minimum Standards (Inventory) for repeat <br />violations of Title 27, California Code of Regulations (CCR), Division 2, Subdivision 1, Consolidated <br />Regulations for Treatment, Storage, Processing, or Disposal of Solid Waste, Section 20919 — Gas <br />Control. <br />Subsequent to the issuance of the Ninety -Day Notice of Intent letter, Board staff in agreement with the <br />San Joaquin County Environmental Health Department (local enforcement agency), determined that the <br />landfill gas issues at Forward Landfill Inc. warranted a violation for Title 27, CCR, Section 20919.5 — <br />Explosive Gases Control rather that a violation for Title 27, CCR, Section 20919 — Gas Control. <br />Therefore, Board staff are reissuing the September 23, 2003, Ninety -Day Notice of Intent letter to <br />include Forward Landfill Inc. on the Inventory for the violation of Title 27, CCR, Section 20919.5 — <br />Explosive Gases Control per your local enforcement agency inspection reports from September through <br />December 2003. <br />California Environmental Protection Agency <br />Printed on Recycled Paper <br />The energy challenge facing California is real, Every Californian needs to take immediate action to reduce energy <br />consumption.
