If all 3 phases of gas extraction wells succeed in obtaining less than 5% of <br />explosive gas at the boundaries, the operator shall continue monitoring and <br />reporting at described in item 1 and 2 for 4 consecutive quarters. <br />The operator shall maintain the concentration of explosive gas at the boundaries <br />below 5% by volume by April 20, 2005. <br />PLEASE TAKE FURTHER NOTICE: <br />A. Pursuant to PRC 44307 and 44310, the owner/operator have the right to request a <br />hearing before the Solid Waste Independent Hearing Panel in regards to this <br />Notice and Order within 15 days of receipt of this Notice and Order. <br />B. Failure to correct the above violation could result in a civil penalty not to exceed <br />ten thousand dollars ($10,000) for each day the violation occurs, as cited in PRC <br />45023 or in the suspension or revocation of the solid waste facility permit as cited <br />in PRC 44106 (b) and 44306.
