Box 6336
1145 W. Charter Way - Stockton, CA 95206
(209) 466-4482 - (800) 204.4242 • FAX (209) 466-1067
, L 1111y/MI I D
ENV;ROPdN4NT HEALI-j
PERMIT/SERVICES
We agreed to provide this follow-up correspondence to the recent meeting with
California Integrated Waste Management Board Staff regarding the State
Inspection Report on Forward Landfill dated May 4, 2005. This letter is
intended to summarize our position on the issues raised in that inspection report,
to establish an understanding of the items of agreement and to set the stage for
the development of our proposed action plan for addressing the issues raised in
the report. We appreciate your willingness to attempt to reach reasonable
solutions for the issues covered by the report. We will provide you with an action
plan by Monday, May 16, 2005 and we forward to discussing that action plan
with you at your convenience later that week.
i. Daily Tonnage Received
❖ We conceded at the meeting that the daily tonnage and weekly
tonnage cap includes all disposed waste and all soils considered to
be designated wastes or required to be disposed by Air Pollution
Control District rules.
❖ We conceded that the Monthly tonnage reports submitted to the
LEA need to be revised to more clearly state the amount and type of
material received for use as Alternative Daily Cover, other cover and
other forms of beneficial reuse. However, reports previously
submitted to the LEA and Board staff clearly and accurately reflect
the total amount of disposed waste and waste materials used for
cover (including ADC) and other beneficial reuse. We will submit
to the LEA on May 16, 2005 a revised reporting format.
❖ We dispute the LEA interpretation that all materials received at the
gate count against the daily and weekly cap and will provide the
LEA on May 16, 2005 further support for this interpretation or an
alternative plan for maintaining reasonable tonnage caps for the
facility.
