These records are available for your review and should satisfy any concerns <br />that non disposal soils are somehow being misused at the Forward facility. <br />Given the foregoing, we respectfully request that you revise your report to eliminate <br />references to violations related to our permitted daily and weekly tonnage caps. We <br />understand that there is an outstanding issue concerning whether material used as <br />Alternative Daily Cover (ADC) or beneficial reuse counts towards the daily cap and we <br />are willing to work through you and CIWMB staff to resolve that issue. As noted <br />previously, we are still below the daily and weekly tonnage thresholds even if we include <br />ADC and beneficial reuse materials in our daily and weekly waste receipts (as confirmed <br />by review of the attached daily reports for June 2005). <br />Amended RDSI <br />As we have indicated to you over the past couple of months, we are in the final stages of <br />preparing an amended Report of Disposal Site Information that is required by the new <br />ADC regulations. The document will also clarify and update information in the current <br />document that has led to some confusion (i.e., cover ratios, site operational info, etc.). At <br />the joint meeting with CIWMB staff, we committed to provide you with the RDSI <br />amendments by July 31, 2005. We are on track for submittal of this document to you <br />and appreciate your patience in working through the matter. You will most likely receive <br />the document prior to drafting your report for our July site inspection and we would <br />appreciate not having this issue listed as a violation on future inspection reports <br />(including the one for July 2005). <br />By submittal of the report we believe we have complied with the regulatory criteria as <br />well as your request to clarify various aspects of the document. While there may be areas <br />of the amended RDSI which you require clarification on, we would hope that those can <br />be handled through mutual cooperation and not through the use of continued violations. <br />Gas Control on Forward Landfill Site <br />Our project teams are currently installing 23 additional gas extraction wells in the area <br />where gas has accumulated on the west end of the Forward Landfill site. We are hopeful <br />that this latest phase of capital investment and engineering work will alleviate the issues <br />related to exceedance of thresholds for methane gas. This work is scheduled to be <br />completed by July 29, 2005 and its effectiveness can be gauged at that point. Forward, <br />Inc. is committed to addressing this issue and we believe that our investment in <br />infrastructure to control the methane gas has demonstrated this commitment. <br />Green Waste Containing Food Waste <br />The subject of yard waste containing food waste and the ability to use the material for <br />ADC has been the subject of much debate with the LEA and the CIWMB staff over the <br />course of the past several months. <br />2 <br />
