While we are hopeful that a mutually agreeable solution can be reached with your agency as well as CIWMB staff, we have been diligently pursuing offsite processing alternatives that would alleviate your concerns altogether. To date we have not been able to firmly establish a viable outlet for the material although we do have a couple of reasonably promising options. Despite our differences of opinion on the matter, it is our intent to reach a mutually agreeable consensus on this matter. As such. we would appreciate your cooperation as we explore alternatives jointly with you and the CIWMB staff and we request that your inspections respect the fact that a reasonable difference of opinion exists on the various regulatory interpretations related to this issue. Area of Concern - Closure of the North Side of Former Austin Road Landfill As you are aware we are in the process of preparing to close the north side of the former Austin Road Landfill. This work should begin shortly and the project schedule calls for the work to be completed prior to the beginning of the wet weather season (end of October). Our project engineering staff is working diligently towards this goal and at this point in time believes we are on track. We submitted the Stage 1 A Partial Final Closure/Postclosure Maintenance Plan (PFCPCP) to the LEA, CIWMB and the RWQCB on June 16, 2005. So far, we have received several verbal responses regarding the Plan. The CIWMB had only minor comments and the RWQCB will have no comments. Therefore, we are prepared to proceed once we have received comments from the LEA. Completion of this work should alleviate your concern relative to the leachate seep that occurred in this area during this past winter. We are currently working to address the remaining areas of concern that were highlighted in the June inspection report and look forward to moving ahead in a cooperative manner. Our staff is very willing to meet and discuss the contents of this transmittal with you in the event it would be helpful. Otherwise, we look forward to your comments on the amended RDSI and completing our construction activities relative to gas control and closure of a portion of the Austin Road Landfill.
