XXI. On March 2,2004,this LEA received the progress report for Amended Notice <br /> and Order 03-01. According to the progress report,the operator/owner <br /> proposed to install 52 gas extraction wells in 3 different phases. All new gas <br /> extraction wells would be connected to the existing flare station. <br /> XXII. On March 22,2004, Bryant A. Stirrat& Associates, on behalf of Regenesis <br /> Group, obtained the EHD Well Permit to install up-to 50 gas extraction wells at <br /> Forward Landfill. <br /> XXIII. On March 26, 2004, this LEA conducted routine inspection and noted that the <br /> concentration of methane gas in the gas monitoring probes GP-8 (which , <br /> replaces GP-3)and GP-9 (which replaces GP-2), both of which were located <br /> near the west boundary,was 44%and 42%, respectively. This was documented <br /> under the violation of Explosive Gases Control, Section 20919.5 of 27CCR. <br /> XXIV. On April 20,2004, this LEA measured the gas concentration in the impacted <br /> gas probes to determine the facility compliance status with the Amended Notice <br /> and Order 03-01, dated February 2, 2004. The concentration of methane gas in <br /> GP-8 and GP-9 was 45% and 47%,respectively. <br /> XXV. On April 20,2004, California Integrated Waste Management Board (CIWMB) <br /> place Forward Landfill on the Inventory of Solid Waste Facilities Violating <br /> State Minimum Standard for the violation of 27CCR20919.5, Explosive Gas <br /> Control. <br /> XXVI. On April 27,2004, this LEA conducted routine inspection and noted that the <br /> concentration of methane gas in the gas monitoring probes GP-8 (which <br /> replaces GP-3) and GP-9 (which replaces GP-2), both of which were located <br /> near the west boundary, was 43%and 45%, respectively. This was documented <br /> under the violation of Explosive Gases.Control, Section 20919.5 of 27CCR. <br /> XXVII. This Amended Notice and Order 03-01, dated May 6, 2004,is intended to meet <br /> the requirements of Public Resources Code(PRC), Division 30, Section <br /> 44106(x)fora compliance schedule. <br /> VIOLATIONS: <br /> Consequently,the Forward Landfill has operated in violation of the following section(s) <br /> of 27CCR: <br /> 27CCR 20919.5 Explosive Gases Control <br /> (a) Owners or operators of all MSWLF units must ensure that: <br /> (2) The concentration of methane gas does not exceed the lower explosive <br /> limit for methane at the facility property boundary. <br /> Amended Notice and Order 03-01 Page 4 of 7 Forward Landfill <br /> May 10,2004 <br />
