1.0 INTRODUCTION <br /> 1.1 PURPOSE <br /> A Hazardous Waste Exclusion Program (HWEP) for the Forward Landfill (FL) has been <br /> developed to discover and discourage attempts to dispose hazardous or other <br /> unacceptable wastes, including universal wastes (such as universal waste batteries, <br /> universal waste mercury-containing devices, cathode ray tube devices, universal waste <br /> fluorescent tubes/bulbs/mercury-containing lamps, universal waste electronic devices, <br /> non-aerosol cans that contain hazardous materials, etc.) and polychlorinated biphenyls <br /> (PCBs), at the landfill. In addition, the HWEP is designed to prevent, to the extent <br /> possible, the acceptance of prohibited wastes into the landfill's waste stream. <br /> 1.2 REGULATIONS <br /> The HWEP complies with State and federal regulations under Title 27 California Code <br /> of Regulations (27 CCR), Section 20220 and 20870. These regulations state that the <br /> "Owners or operators of all Municipal Solid Waste Landfills (MSWLF) units must <br /> implement a program at the facility for detecting and preventing the disposal of <br /> regulated hazardous wastes as defined in Part 261 of this chapter (40 CFR Chapter 1) <br /> and PCB wastes as defined in part 761 of this chapter (40 CFR Chapter 1)". This <br /> program must include at a minimum: <br /> 1. Random inspections of incoming loads unless the owner or operator takes <br /> other steps to ensure that incoming loads do not contain regulated hazardous <br /> wastes or PCB wastes. <br /> 2. Records of any inspections. <br /> 3. Training of facility personnel to recognize regulated hazardous wastes and PCB <br /> wastes. <br /> 4. Notification of the Enforcement Agency (EA), the Director of the California <br /> Department of Toxic Substances Control (DTSC) or delegated agent, and the <br /> Regional Water Quality Control Board (RWQCB), if regulated hazardous waste <br /> or PCB waste is discovered at the facility in accordance with 27 CCR, Section <br /> 20870(a)(4). <br /> 5.
