3.0 REGULATORY BACKGROUND, PERMITS, AND <br /> ® EXISTING ENVIRONMENTAL INFORMATION <br /> 3.1 EXISTING PERMITS AND APPROVALS <br /> The operation of a Class II/III landfill in the State of California requires that the <br /> project applicant obtain approval from the local and State agencies having <br /> jurisdiction over the handling and disposal of non-hazardous solid waste. This <br /> section describes the existing permits, the responsible agencies which have <br /> jurisdiction over FL, and the permits that may be required to operate the facility as <br /> described. The Final EIR will consider all listed project approvals, as well as any <br /> other approval necessary or desirable, to implement the project. <br /> 3.1.1 LAND USE PERMIT <br /> The FL currently operates under Land Use Permit (LUP) No. UP-00-7 as approved <br /> by the County of San Joaquin Board of Supervisors in April 2003. A Use Permit <br /> ® Application Package (dated February 15, 2008) has been submitted to the San <br /> Joaquin County Development Department to update the current LUP to reflect <br /> proposed design and operational changes associated with the landfill expansion. <br /> 3.1.2 WASTE DISCHARGE REQUIREMENTS <br /> The State Water Resources Control Board (SWRCB) requires that Class II and III <br /> solid waste disposal facilities obtain Waste Discharge Requirements (WDRs). <br /> The Regional Water Quality Control Board (RWQCB), Central Valley Region is <br /> the local agency which issues the site-specific WDRs for the FL. The FL currently <br /> operates under WDR Order No. R5-2003-0049, as well as Monitoring and <br /> Reporting Program (M&RP) No. R5-2003-0049. <br /> 3.1.3 NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT <br /> The RWQCB regulates municipal and industrial stormwater discharge <br /> requirements under the National Pollutant Discharge Elimination System <br /> (NPDES) program. Stormwater discharges from the FL are regulated under <br /> NPDES General Industrial Storm Water Permit.
