3.0 REGULATORY BACKGROUND, PERMITS, AND
® EXISTING ENVIRONMENTAL INFORMATION
3.1 EXISTING PERMITS AND APPROVALS
The operation of a Class II/III landfill in the State of California requires that the
project applicant obtain approval from the local and State agencies having
jurisdiction over the handling and disposal of non-hazardous solid waste. This
section describes the existing permits, the responsible agencies which have
jurisdiction over FL, and the permits that may be required to operate the facility as
described. The Final EIR will consider all listed project approvals, as well as any
other approval necessary or desirable, to implement the project.
3.1.1 LAND USE PERMIT
The FL currently operates under Land Use Permit (LUP) No. UP-00-7 as approved
by the County of San Joaquin Board of Supervisors in April 2003. A Use Permit
® Application Package (dated February 15, 2008) has been submitted to the San
Joaquin County Development Department to update the current LUP to reflect
proposed design and operational changes associated with the landfill expansion.
3.1.2 WASTE DISCHARGE REQUIREMENTS
The State Water Resources Control Board (SWRCB) requires that Class II and III
solid waste disposal facilities obtain Waste Discharge Requirements (WDRs).
The Regional Water Quality Control Board (RWQCB), Central Valley Region is
the local agency which issues the site-specific WDRs for the FL. The FL currently
operates under WDR Order No. R5-2003-0049, as well as Monitoring and
Reporting Program (M&RP) No. R5-2003-0049.
3.1.3 NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT
The RWQCB regulates municipal and industrial stormwater discharge
requirements under the National Pollutant Discharge Elimination System
(NPDES) program. Stormwater discharges from the FL are regulated under
NPDES General Industrial Storm Water Permit.
