Forward operates under numerous permits issued by various federal, state and local agencies <br /> including CUP UP-00-7, which was adopted on April 23, 2003 through Resolution R-03-210 by <br /> the San Joaquin County Board of Supervisors. The CUP contains numerous conditions related to <br /> development and operations at Forward Landfill, however none of them specifically reference <br /> either the existing Covanta LFGTE facility or the existing flare. The condition most pertinent to <br /> the proposed LFGTE facility is Condition 3(f)which states: <br /> "35(E.4) <br /> Proposed as Part of the Project: <br /> Where required by State and Federal regulations, the landfill gas monitoring, gas control and <br /> collection system will be installed, extending to the new areas of the expanding landfill and <br /> operating in conformance with applicable regulations." <br /> In addition to the CUP, LFG collection and control at Forward Landfill is regulated by the San <br /> Joaquin Valley Air Pollution Control District (SJVAPCD) under various permits to operate <br /> (PTOs). The existing LFGTE facility is currently permitted to operate by the SJVAPCD until <br /> April 30, 2013. <br /> If the LFGTE facility proposed by Ameresco is approved,then Ameresco would obtain a permit <br /> to operate (PTO) from the SJVAPCD for the new facility. Ameresco would also design, build, <br /> and operate the proposed LFGTE facility in compliance with the pertinent provisions of all <br /> current Forward Landfill permits. <br /> Submission of this Project Description to the County is the first step in amending UP-00-7 to <br /> incorporate the proposed LFGTE facility at Forward Landfill.
