SHUTE MIHALY
&WEINBERGERLLP
396 HAYES STREET, SAN FRANCISCO, CA 94102
T: 415 552-7272 F: 415 552-5816
www.smwiaw.com
January 13, 2012
Via Via Email
Carroll Mortensen, Director
California Department of Resources
Recycling & Recovery
P.O. Box 4025
Sacramento, CA 95812-4025
Re: Solid Waste Facility Permit No. 39 -AA -0015
Dear Ms. Mortensen:
LAUREL L. IMPETf, AICP
Urban Planner
impett@smwlaw.com
On behalf of Mike and Jeannie La Forge, we have reviewed the
documentation relating to proposed revisions to Solid Waste Facility Permit No. 39 -AA -
0015 for the Forward Landfill (hereinafter "SWFP Revision" or "Project"). We
respectfully submit these comments to help ensure that agency decision -makers fully
comply with the California Environmental Quality Act ("CEQA"), Public Resources
Code § 21000 et seq. The La Forges are deeply concerned about the far-ranging
environmental impacts that would accompany the proposed change in operations at the
Forward Landfill. For the reasons set forth below, we respectfully request that the
California Department of Resources Recycling & Recovery ("Calrecycle") deny the
SWFP revision.
According to the November 18, 2010 Initial Study/Negative Declaration
prepared for the SWFP Revision ("SWFP ND"), the Project includes two components:
(1) relocation of the landfill's facility boundaries to include an additional 184 acres; and
(2) increasing the number of days the facility will operate on Sunday (from 10 to 20
days). It is our opinion that the SWFP ND does not comply with CEQA because it does
not adequately describe the proposed Project and does not analyze the Project's
significant environmental impacts. In addition, the applicant is currently requesting a
new Conditional Use Permit ("CUP") from the San Joaquin County Community
