�ii <br />0 <br />April 8, 2014 <br />Expansion of the landfill into the [Austin Road] Expansion Area shall be <br />preceded by a nesting survey for Swainson's hawks during the breeding <br />season in order to document the presence, location and number of <br />Swainson's hawks nests near or within the Landfill. These nests and other <br />detected nests shall be monitored yearly to document the effect if any of <br />the landfill operations on the presence of breeding Swainson's hawks and <br />on the success of breeding Swainson's hawks. <br />Current Status: The landfill has not expanded near any of the oak trees <br />where Swainson's hawks would nest. Annual site surveys are performed by <br />Wetlands Research and recommendations are provided regarding setbacks <br />and buffers from potential nesting areas. The most recent survey was <br />performed in 2013 prior to WMU FU -13 construction. <br />b. 72 Austin 2000 (F7.a) <br />According to the SJMSCP, the mitigation fee for conversion of agricultural <br />lands to other uses is $1,500 per acre. For the conversion of 213.9 acres <br />of Agricultural Lands, the County shall pay $320,850 to the SJMSCP Joint <br />Powers Authority to fund acquisition of preserve lands for covered species <br />that could potentially be affected. <br />Current Status: Forward has paid the required mitigation fee. <br />c. 73 Austin 2000 (F94.a) <br />Pre -construction surveys for greater westem mastiff bat should be <br />conducted prior to removing any trees from the project site. These pre - <br />construction surveys may be required and funded by the SJMSCP JPA <br />and should be conducted by a biologist with experience surveying for bats, <br />and the surveys should not occur any more than 30 days prior to the <br />proposed tree removal. If no special -status bats are identified during the <br />pre -construction survey(s), then no impacts to these bats would be <br />expected to occur from construction of the proposed project. If, however, <br />greater westem mastiff bat is identified in any of the trees proposed for <br />removal, reproductive status should be determined. <br />Current Status: No trees have been removed from the project site. <br />d. 74 Austin 2000 (F14.b) <br />(Greater westem mastiff` bat) Matemity sites should be avoided until bats <br />finish rearing young. Prior to _the bats finishing rearing their young, bat <br />roostslmatemal "bat houses" should be placed within a protected area in <br />the vicinity of the roostinglmatemity sites if possible. As soon as young <br />are flying and foraging, the matemity sites should be sealed. Similarly, <br />once bat houses are installed in protected areas, bats should be evicted <br />from their roost sites within the project construction zone (i.e., should be <br />Page 45 <br />
