0 <br />.. . .. ........ ... <br />.. ... ............ . . ... .. <br />1:0 INTRODUCTION <br />PROPOSED PROJECT <br />The San Joaquin County Community Development Department has determined that an Environmental <br />Impact Report (EIR) is required to study a request for a Use Permit to establish a Materials Recovery and <br />Transfer Facility. The 39.2 -acre project site is located south of the City of Tracy, on the west side of <br />MacArthur Drive, south of Linne Road. Access to the site is via MacArthur Drive. <br />Under the California Environmental Quality Act (CEQA), Public Resources Code, Section 21000, et seq., <br />the purpose of an EIR is to provide objective information to public decision makers and the general public <br />regarding potential environmental effects resulting from the proposed project. <br />CEQA requires that where a project is to be carried out or approved by more than one public agency, <br />one agency shall be responsible for preparing the EIR. This agency is called the lead agency. The San <br />Joaquin County Community Development Department is the lead agency for this EIR. <br />The proposed Tracy Materials Recovery and Transfer Facility is considered a "project" as defined by CEQA <br />Guidelines (14 California Code Regulations, Section 15378). The Guidelines require preparation of an EIR <br />when the lead agency determines that there is substantial evidence on record that a project may have <br />a significant effect on the environment (Guidelines, Section 15064). The County Community Development <br />Department staff has made such a determination. <br />As lead agency, San Joaquin County Community Development staff determined during preliminary project <br />review that an EIR would be required for the proposed project (Guidelines, Section 15060). Based on this <br />early EIR determination, no Initial Study was prepared, and work was started on the EIR process, as <br />described in Section 15080 of the CEQA Guidelines. County staff prepared a Notice of Preparation (NOP) <br />that was circulated to local, regional, state, and federal agencies and other interested parties. This NOP <br />and the responses are provided in this EIR as Appendix A. <br />The major environmental issues identified during the NOP process that will be addressed in this document <br />include land use/planning policy, vegetation and wildlife resources, traffic/circulation, <br />geology/geotechnical, water resources, noise, air quality, public services, cultural resources, public health <br />and safety, and visual/aesthetics. <br />The Draft EIR addresses the concerns raised by the public agencies and the community. It is an <br />informational document to aid in the local planning and decision making process. This document <br />describes the probable consequences that the proposed project may have on the environment, presents <br />measures to minimize potential adverse impacts, and evaluates alternatives to the proposed project. <br />This Draft EIR is being circulated to local, state, and federal agencies and to all interested organizations <br />and individuals who may wish to review and comment on the report. Both written and oral comments may <br />be made during the 45 -day public review period.
