E <br />A ` � <br />Memorandum of Understanding <br />Between <br />California Department of Transportation <br />And <br />San Joaquin County (Department of Public Works) <br />Regarding the <br />Corral Hollow Landfill and Vicinity <br />THIS Memorandum of Understanding (MOU) is entered into this _ day of , <br />2011, (Effective Date), between the County of San Joaquin, a political subdivision of the State of <br />California (County) and the State of California Department of Transportation (Caltrans). <br />RECITALS <br />This MOU is predicated upon the following: <br />• San Joaquin County owns property located west of the intersection of Interstate 580 and <br />Corral Hollow Road near Tracy, California, containing the Corral Hollow Sanitary Landfill. <br />This landfill is administered by the Solid Waste Division of the Department of Public <br />Works (Figure 1). <br />• Most of this landfill received a final closure cap in 1996, but an area of approximately <br />1.1 acres has been found to contain refuse; however, it has not received a closure cap. <br />• Land east of, and adjacent to, the landfill property is owned by the State of California <br />(State) as part of the right-of-way for Interstate 580 and is administered by Caltrans. <br />Approximately 0.2 acre of this State-owned property has been found to contain refuse <br />and is not covered with a closure cap. The State was not aware of the presence of <br />refuse in this property when it was acquired. <br />• Presence of refuse in State property subjects the State to significant liability which <br />cannot easily be quantified. <br />• The cost of installing a closure cap over both the State-owned and County -owned areas <br />is estimated to be approximately $380,000. <br />• Staff of the Central Valley Regional Water Quality Control Board (RWQCB) prepared a <br />Water Code Section 13267 Order for Technical Reports, dated 7 July 2011, requiring the <br />County to submit, with a Letter of Agreement from Caltrans: <br />o A Final Cover Expansion Design for extending the closure cover over the <br />uncovered refuse. The Final Cover Expansion Design shall satisfy the <br />requirements set forth in the Technical Order. Alternatively, Caltrans may <br />submit a clean closure plan meeting the requirements of Title 27 of the <br />California Code of Regulations Sections 20950(2)(B), 21090(f) and 21810(a) -(e). <br />However, the County and Caltrans have agreed to pursue a single project to <br />extend the closure cover over the refuse on both properties. <br />Memorandum of Understanding <br />Corral Hollow Landfill Closure and Related <br />State of California (Caltrans) <br />San Joaquin County (Department of Public Works) <br />
