This item of understanding does not transfer ownership of property to the County, nor <br />cause the County to become responsible for financial assurance, permitting documents, <br />or other issues arising from the refuse in State-owned property. <br />2. Installation of Groundwater Monitoring Wells in State Right-of-way. <br />Caltrans will issue encroachment permits allowing the County temporary license to <br />locations in the State's right-of-way to install groundwater monitoring wells at locations <br />approved by Central Valley Regional Water Quality Control Board staff. The well <br />locations will be selected to minimize intrusion on Caltrans activities. Issuance of the <br />encroachment permits is predicated upon completion of the California Environmental <br />Quality Act process, to the satisfaction of Caltrans, by the County. It is contemplated <br />that these wells will include above -ground locking enclosures and approximately three <br />bollards, all painted safety yellow. <br />The County will share the results of groundwater analyses with the State. <br />All costs associated with the installation, monitoring, and maintenance of the wells will <br />be borne by the County. It is contemplated that Caltrans will continue vegetation <br />maintenance or fire suppression activities in the areas where these wells are installed. <br />3. Acquisition by the County of State-owned Land Now Containing Refuse <br />The County will acquire ownership of the State-owned property that contains refuse, <br />plus a small buffer area, for a total of approximately 0.6 acre. The final area to be <br />relinquished to the County will be determined in discussions between Caltrans and <br />County staff. <br />Caltrans will survey the right-of-way and create a separate parcel of the area to be <br />acquired by the County. <br />Commencing when the County acquires ownership of this property, the County will hold <br />harmless and defend the State against any and all liability associated with the refuse on <br />that property. <br />The State of California Department of Transportation will pay to the County the total of <br />$230,000 for the transfer of this property, this amount including all reimbursements to <br />San Joaquin County identified in Item 1, that is, the total cost to the State of California <br />for Items 1 and 3 will not exceed $230,000. <br />Memorandum of Understanding 3 State of California (Caltrans) <br />Corral Hollow Landfill Closure and Related San Joaquin County (Department of Public Works) <br />
