By 1 February 2012, the County shall submit an Evaluation Monitoring Program (EMP) <br /> Report evaluating the nature and extent of the release from the unit in accordance with <br /> Title 27, section 20425, subsections (a) through (i). Based on the data collected, the <br /> County shall update the Engineering Feasibility Study (EFS) for corrective action <br /> pursuant to Title 27, section 20420(k)(6), which should be made part of the EMP <br /> Report. <br /> Pursuant to California Water Code section 13267, San Joaquin County Department of <br /> Public Works and the California Department of Transportation are hereby ordered to <br /> submit the following report by the due date below: <br /> 1. By 10 October 2011, the two parties shall submit a Final Cover Expansion Design for <br /> extending the closure cover over the uncovered refuse (estimated to be 1.3 acres on <br /> County property and 0.6 acres on Caltrans' property). The document may be submitted <br /> by the County, with a letter of agreement from Caltrans. The Final Cover Expansion <br /> Design shall include the following: <br /> a. Plans and specifications for the expanded cover that meets the specifications of Title <br /> 27,section 20950, section 21090, and section 21140, alternative final cover design; <br /> b. A Construction Quality Assurance (CQA) Plan prepared in accordance with Title 27, <br /> section 20323 and certified by an appropriately registered professional to satisfy the <br /> requirements of Title 27, section 20324; <br /> c. A schedule for the closure cover construction and completion of the cover; and <br /> d. A revised Final Closure and Post Closure Maintenance Plan Addendum dated 4 April <br /> 2008. <br /> e. Alternatively, Caltrans may submit a clean closure plan meeting the requirements of <br /> Title 27 sections 20950(2)(B), section 21090(f) and section 21810 (a) through (e). <br /> As required by the Business Code section 6735, 7835, and 7835.1, all reports shall be <br /> prepared by a registered professional or their subordinate and signed by the registered <br /> professional. <br /> The Executive Officer may extend the deadlines contained in this Order if either the County <br /> or Caltrans demonstrates that unforeseeable contingencies have created delays, provided <br /> that the County or Caltrans continues to undertake all appropriate measures to meet the <br /> deadlines and makes the extension request at least 30 days in advance of the expiration of <br /> the deadline, in writing. Any request for an extension not responded to in writing by the <br /> Central Valley Water Board shall be deemed denied. The County or Caltrans must obtain <br /> written approval from the Executive Officer for any significant departures from the tasks <br /> described in this Order. <br /> Any person aggrieved by this action of the Central Valley Water Board may petition the State <br /> Water Resources Control Board (State Water Board) to review the action in accordance with <br /> Water Code section 13320 and California Code of Regulations, Title 23, sections 2050 and <br /> following. The State Water Board must receive the petition by 5:00 p.m., 30 days after the <br /> date of this Order, except that if the thirtieth day following the date of this Order falls on a <br /> Saturday, Sunday, or state holiday, the petition must be received by the State Water Board <br />
