This waste was <br /> discovered last year(2005) and to date there does not appear that <br /> anything positive has been done to remedy what should have been <br /> remedied last year or earlier this year. It has taken over a year and still <br /> there is no remediation at this site. CIWMB forwarded you a letter and e- <br /> mails (letter is attached and e-mails are included with this e-mail <br /> response) requesting (repeadetly) to require the operator to adequately <br /> close this portion of the landfill. A Report outlining the investigation to <br /> determine the lateral extent of this waste boundary was performed by the <br /> operator and submitted and reviewed by CIWMB sometimes last <br /> year. However, the Report as stated in our letter based on our <br /> review was inadequate and did not appear to have been completed to <br /> correctly and adeqautely determine the extent of the discovered waste. <br /> CIWMB forwarded a letter(please refer to the attachment) stating lack of <br /> adequate investigation. No response was ever received on our comment <br /> letter. <br /> Your latest e-mail includes a letter(attached in this e-mail) dated April <br /> 19, 2006 to the operator which does not appear to have been sent to <br /> CIWMB Closure section (the section overseeing closure activities at <br /> closed site), rather you have cc'ed a P&I staff(remember that P&I staff <br /> deal with active landfills and not closed sites). It would have been <br /> beneficial to have included Closure staff and sent your letter to someone <br /> in Closure. Please forward CIWMB a copy of your signed letter that was <br /> sent to the operator. <br /> Recently, the operator forwarded you a plan dated October 30, 2006 and <br /> has proposed to start work on this site on November 2, 2006. Of course <br /> that does not give CIWMB enough time to review what they had <br /> submitted, however as I had stated to you in an e-mail response to your <br /> e-mail, I would need at least 20 days to review their submittal. I <br /> suggest (as I have in the past) that before we even go any further on <br /> what the operator wants to do at this site, we need to have the operator <br /> to adequatel4det_ermine the lateral extent of the waste requiring cover. <br /> Once the extent has been adequately determined, then work might begin <br /> on how to remedy the waste. As of yet, 1 do not believe the waste <br /> boundary has been determined. <br /> You have stated that the operator has been in contact with RWQCB staff <br /> regarding this issue. I have repeatedly requested to include RWQCB <br /> and other agencies in all e-mails, however that has not happened as of <br /> yet. Since the waste should be adequately covered and this portion of <br /> the landfill closed in accordance with 27 CCR , then I suggest RWQCB <br /> to be given the opportunity to review all plans (delineation and <br /> remediation of the waste) and make comments. It appears that RWQCB <br /> might have the final approval on the adequacy of plans. So, please <br /> assure (as requested previously)that RWQCB is aware of what has <br /> been going on at tis site with regards to the remediation of the <br /> 1/10/2007 <br />
